GENERAL CONDITIONS

PART I — WEBSITE TERMS & CONDITIONS

These thirteen sections govern use of the Wet Spot Diving website and clarify course inquiries, diving safety, reservations, gear purchases, intellectual property and customer rights.

SECTION 01 / 13

1. Who we are and what these Terms cover

These Website Terms & Conditions (“Terms”) apply to https://wetspotdiving.com and its content, contact forms, dive-course listings, experience inquiries, and gear-catalogue pages. The website is operated by Wet Spot Scuba, a diving business in Dauin, Negros Oriental, Philippines. Registered legal operator: Wet Spot Scuba Diving Services .

Please read these Terms before submitting an inquiry or using the website. Separate written enrollment, booking, safety, payment or purchase terms may apply to a confirmed activity or in-store purchase. If those terms conflict with the website information, the specifically agreed transaction terms apply to that transaction, subject to applicable law.

SECTION 02 / 13

2. Website information is not a confirmed booking

The website presents ISC scuba courses, professional and specialty training, non-diver safety courses, local guided dives and related experiences in and around Dauin and Apo Island. Submitting an inquiry or using a “Book”, “Message to Order”, “Enquire” or similar button does not, by itself, guarantee course placement, certification, gear availability, a price hold or a confirmed reservation.

A reservation or service commitment exists only when Wet Spot confirms the details directly, including the selected service, date, availability, participant requirements, price and any applicable payment or cancellation conditions. If a website function expressly supports binding online bookings in the future, its disclosed checkout and acceptance terms will govern that booking.

SECTION 03 / 13

3. Course participation and certification

SECTION 04 / 13

4. Diving safety and participant responsibilities

Scuba diving and water activities carry inherent risks. Participants must follow instructor or guide instructions, honestly disclose relevant experience and information requested through the proper screening process, use equipment responsibly, observe buddy and environmental procedures, and avoid participation when unfit to dive.

Wet Spot may decline, postpone or end participation when reasonably necessary for safety, competency, environmental protection or compliance with applicable requirements. Any separate assumption-of-risk acknowledgment or informed-consent form should be supplied and explained before participation; these website Terms are not a substitute for that form.

SECTION 05 / 13

5. Pricing, schedules and changes

Course rates, itineraries, starting prices, listed durations and other website information are provided for reference and may be updated. Exact inclusions and exclusions, taxes or fees, equipment, training materials, certification fees, transport and site fees must be confirmed in the individual quote or booking confirmation before payment.

Sea state, weather, marine-park rules, access restrictions, instructor availability, operational requirements or other circumstances may require reasonable schedule or location changes. Wet Spot will explain practical alternatives or the applicable refund/rescheduling options, consistent with agreed terms and law.

SECTION 06 / 13

6. Deposits, cancellations and refunds

Any deposit, payment deadline, cancellation window, no-show treatment, refund or rescheduling rules for a dive activity must be clearly disclosed in the written quote or confirmation before the booking is finalized. No general cancellation penalty or non-refundable payment is created solely by visiting this website. Statutory consumer rights and mandatory legal remedies are not excluded by these Terms.

SECTION 07 / 13

7. Gear shop: catalogue and in-store sales only

Our Gear Shop webpage is an informational catalogue for scuba equipment, accessories, parts, tools and apparel. It is intended to help customers request product details, availability, sizing or fitting advice through WhatsApp, Messenger or other contact methods. It does not operate as a website checkout and does not accept online payment for gear.

Gear purchases are finalized at the physical shop after price, item suitability and stock are confirmed. Customers may pay in-store by cash or accepted credit card, subject to the payment methods available at the point of sale. Catalogue images may illustrate products; specifications, stock, warranties and returns are confirmed at purchase and remain subject to applicable Philippine consumer-protection law.

SECTION 08 / 13

8. Responsible use of the site

You agree not to submit false or misleading requests, interfere with website security, attempt unauthorized access, post harmful content or misuse our communication channels. Do not include payment-card data, passwords or unnecessary sensitive health details in the public contact form.

SECTION 09 / 13

9. Intellectual property and third-party links

Unless otherwise credited, website text, design and Wet Spot branding belong to Wet Spot Scuba or its licensors and may not be copied for commercial use without written permission. ISC and other certification, product or partner marks remain the property of their respective owners. Links to WhatsApp, social platforms, maps or outside websites are provided for convenience; the third party’s own terms and policies apply when you use those services.

SECTION 10 / 13

10. Photos, testimonials and contributions

If you voluntarily send a review, photograph or testimonial, you confirm you have the right to share it. Wet Spot will seek separate appropriate permission before using identifiable customer photographs, videos or testimonials for marketing where required; merely participating in a dive does not create a blanket marketing release.

SECTION 11 / 13

11. Availability, liability and consumer rights

We aim to keep website details accurate and available, but technical errors or temporary interruptions may occur. To the extent permitted by law, Wet Spot does not warrant uninterrupted website access or that informational articles replace professional instruction. Nothing in these Terms excludes liability that cannot lawfully be excluded, including applicable responsibility for negligence, injury, fraud or statutory consumer protection.

SECTION 12 / 13

12. Privacy and contact

Use of personal information submitted through this website is described in our Privacy Statement; cookie information appears in our Cookie Policy. Contact Wet Spot Scuba at [email protected], WhatsApp +63 921 091 5680, or 2nd Floor Mega Market, Dauin, Negros Oriental 6217, Philippines.

SECTION 13 / 13

13. Governing law and updates

These Terms are governed by the laws of the Republic of the Philippines. Disputes should first be raised with Wet Spot so a practical resolution may be explored; consumers may also use applicable legal or regulatory remedies. Where a court proceeding is required, jurisdiction and venue will be determined under applicable law rather than any unfair restriction on statutory rights.

We may update these Terms prospectively. Updated Terms will be posted with a revised review date; existing confirmed transactions remain subject to their applicable agreed terms and mandatory law.

OUR COMMITMENT TO PRIVACY, TRANSPARENCY & RESPONSIBLE MARKETING

PART II — ARTIFICIAL INTELLIGENCE (AI) IMAGE & CONTENT POLICY

At Wet Spot Scuba (Wet Spot Diving), we use artificial intelligence, image-enhancement technologies and digital design tools in marketing while respecting guest privacy and representing our dive experiences responsibly. This Part II explains how AI-generated and AI-enhanced materials may appear on our website and marketing channels.

AI POLICY 01 / 07

A. Why We Use AI-Enhanced Promotional Images

Our promotional materials may combine several production techniques, depending on the campaign:

Why these tools are used

Because marketing imagery may be widely shared through social media, blogs, search engines and third-party sites, responsibly produced AI-enhanced visuals can help reduce reliance on identifiable guest photographs.

AI POLICY 02 / 07

B. Guest Privacy Protection

Promotional marketing images

Illustrative, AI-generated or AI-enhanced imagery may be used in the following marketing placements:

These promotional visuals may contain AI-generated individuals, AI-modified people, composite imagery or digitally enhanced scenes. Such people are not necessarily actual Wet Spot guests, students or participants; illustrative images are not documentary proof of a particular dive, facility, wildlife sighting or group.

Authentic guest photos

Where a dive-experience or course page provides a designated “Guest Submitted Photos” section or gallery, it is intended for authentic photographs voluntarily provided by actual guests or their authorized creators.

AI POLICY 03 / 07

C. Social Media Sharing & Viral Distribution

Once imagery or other content is posted online, it may be:

Wet Spot Scuba therefore aims to limit the appearance of identifiable guest images in primary promotional materials unless appropriate permission has been obtained. We cannot guarantee that third parties will never copy or further distribute publicly available content.

AI POLICY 04 / 07

D. Transparency Statement

We want visitors and customers to understand the difference between promotional illustrations and real experiences:

We use AI to enhance visual presentation and support privacy, not to mislead. Illustrative underwater imagery does not promise a particular animal encounter, visibility, sea condition, dive-site access or training outcome.

AI POLICY 05 / 07

E. Guest Photo Consent

Guests and other creators who voluntarily submit photographs should understand that:

Where publication permission is obtained, it should identify the intended uses. Removal requests will be addressed in accordance with applicable law and practical technical limitations, including copies already circulated through third-party platforms.

AI POLICY 06 / 07

F. Responsible Use of Artificial Intelligence

Wet Spot Scuba does not intentionally use AI-generated or AI-modified materials to:

Permitted purposes

Factual statements about courses, destinations, safety, pricing, services and inclusions should be verified against current operating information and communicated accurately. AI output does not replace qualified dive instruction, safety briefings or official course standards.

AI POLICY 07 / 07

G. Updates to This AI Policy

This AI Image & Content Policy may change over time to reflect:

The current text will be published on this website with the applicable review or effective date. Material updates should be brought to users’ attention where required. Continued use of the website after an update may be subject to the revised website terms, but changes do not retroactively override confirmed bookings, separate consents or rights provided by law.
